Say no to expropriation for nil compensation

The comment period on the proposed amendments to Section 25 of the Constitution closes on 13 August 2021. The committee specifically requests comments on the following issues:

• Where land and any improvements thereon are expropriated for the purposes of land reform, the amount of compensation payable may be nil;
• That national legislation must provide circumstances where the amount of compensation is nil;
• Land should be a common heritage of all citizens that the state must safeguard for future generations;
• Conditions should be fostered to enable state custodianship of certain land in order for citizens to gain access to land on an equitable basis; and
• To provide for matters connected therewith.

The Expropriation Bill comes at a time of one of the most devastating economic implosions in the history of South Africa, with downgradings of SOE’s beyond junk status, escalating sovereign debt, high numbers of bankruptcies of businesses, withdrawal of foreign investments and the highest unemployment rate ever. There can be no worse time for an Expropriation Bill like this one, given the uncertainties it entails, to be promulgated into law.

The draft Expropriation Act will enable the government to arbitrarily deprive you of your property.
